Terms of Service

1. Parties and Acceptance

These Terms of Service ("Terms") constitute an electronic agreement between Octopus Software ("OrderAI") and the user ("Customer") accessing the services via orderai.com.tr. By registering on the platform or starting to use the services, you are deemed to have accepted these Terms.

2. Description of Service

OrderAI provides AI-powered QR menu, digital waiter, and order management system services for food and beverage establishments. The scope and pricing of the service are specified on the Pricing page.

3. Trial Period

New registrations are granted a 14-day free trial period. A valid payment method (credit/debit card) must be defined during the trial period in order to activate the AI ordering feature. At the end of the trial period, billing is only done based on the number of actual AI orders; no fixed subscription fee is charged.

4. Pricing and Payment

  • OrderAI applies a usage-based (pay-as-you-go) pricing model.
  • Each month, an invoice is generated by calculating the number of AI orders from the previous month.
  • The invoice amount is automatically charged from your registered payment method.
  • The payment infrastructure is provided via PCI-DSS compliant PayTR.
  • Your card details are not stored on OrderAI servers; only secure token information is kept.

5. Customer Obligations

  • Register on the platform with true and up-to-date information.
  • Ensure account security and keep the password confidential.
  • Use the service only for lawful purposes.
  • Do not use software or methods that will harm the system.
  • Keep payment information up to date.

6. Intellectual Property

The OrderAI platform, its design, software, and contents belong to Octopus Software and are protected under copyright law and other intellectual property laws. The Customer declares that they are the copyright owner of the menu contents and images uploaded within the scope of the service.

7. Limitation of Liability

OrderAI cannot be held responsible for service interruptions caused by internet connection disruptions, third-party payment system failures, or force majeure. It is not guaranteed that the service will run uninterrupted and error-free; however, necessary measures will be taken to resolve issues within a reasonable time.

8. Suspension or Termination of Service

The service may be suspended or terminated in case of payment failure, usage against the terms, or account request. The Cancellation and Refund Policy applies to account closure requests.

9. Amendments

OrderAI reserves the right to update these Terms by giving prior notice. Significant changes are notified by email. Continuing to use the service after the changes indicates your acceptance of the new Terms.

10. Governing Law

These Terms are interpreted under Turkish law. Istanbul Courts and Execution Offices are authorized for disputes.
